End User License Agreement

IMPORTANT: Please read this End User License Agreement ("Agreement") carefully before using the software provided by DeltaSketch ("Author," "We," "Us," or "Our"). By installing, copying, or otherwise using the software ("Software"), you ("You," or "User") agree to be bound by the terms and conditions of this Agreement.
If you do not agree to the terms of this Agreement, do not install or use the Software.
1. Version Information
This Agreement applies to the version of DeltaSketch you are installing. If you install or use any subsequent versions of the Software, you may be required to accept a new version of this Agreement.
2. License Grant
The Author hereby grants you a non-exclusive, non-transferable, revocable license to install and use the Software solely for personal or internal business purposes, subject to the terms and conditions set forth in this Agreement.
3. License Key and Activation
A valid license key is required for full use of the Software beyond the trial period. Each license key is activated on a per-machine basis using an anonymised hardware identifier. You may not share, resell, or transfer your license key to another party. You may deactivate the Software on one machine to activate it on another, subject to the activation limits of your license. Internet connectivity is required for initial activation and for periodic revalidation (approximately every 30 days). A grace period of up to 7 days is granted for temporary offline use.
4. Trial Mode
The Software includes a time-limited free trial of 14 days, during which all features are available. No license key is required during the trial period. At the end of the trial, a valid license key must be entered to continue using the Software. The trial may only be started once per machine.
5. Purchase & Payment
Purchases are processed by Paddle, our Merchant of Record. Paddle charges your payment method, handles VAT/sales tax, and issues receipts. By purchasing through Paddle you also agree to Paddle's Buyer Terms.
All prices are one-time payments — there is no recurring subscription.
6. Refunds
Refunds are available under limited conditions, including accidental purchases (within 7 days), unresolvable technical issues, and duplicate or fraudulent charges. Change of mind after activation or use is not eligible.
If you are located in the European Union, you may have statutory withdrawal rights for digital goods. By purchasing, you explicitly consent to immediate delivery and acknowledge that withdrawal rights may be lost once access begins, where permitted by applicable law.

7. Intellectual Property
You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent that such activity is expressly permitted by applicable law or required by the terms of any open-source or free software license governing components incorporated in the Software (such as the GNU Lesser General Public License v2.1). You may not redistribute, sell, lease, or sublicense the Software to any third party without prior written consent from the Author.
The Author does not claim ownership of third-party open-source components included in the Software. In particular, this Software incorporates FFmpeg, which is the property of its respective owners. See Section 20 for details.
8. Limitation of Liability
The Author shall not be liable for any damage, loss, or injury arising from the use of the Software, including, but not limited to, any direct, indirect, incidental, or consequential damages, loss of data, loss of profit, or business interruption, even if the Author has been advised of the possibility of such damages. You agree to use the Software at your own risk.
9. User Responsibility
The Author shall not be held liable in any way for the use of the Software or the images created with it. It is the user's responsibility to ensure that their use of the Software and the content they create comply with all applicable laws and regulations.
10. No Guarantee of Compatibility
The Author does not guarantee that the Software will function properly with all hardware configurations. DeltaSketch requires a graphics driver supporting at least OpenGL 3.3. Full GPU-accelerated features require OpenGL 4.3 or newer. It is your responsibility to ensure your hardware meets the minimum requirements before installation.
11. Disk Space Usage
By using the Software, you acknowledge that the Software may create and store captured images, project files, and configuration data on your device. You are responsible for managing storage and ensuring your device has adequate space for the Software's operations.
12. No Warranties
The Software is provided "as-is," with no warranties or representations of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose. The Author makes no warranties regarding the performance, reliability, or suitability of the Software.
The Author is under no obligation to provide technical support, maintenance, or updates for the Software. Any updates, if made available, are at the sole discretion of the Author and may be subject to additional terms.
13. Updates and Maintenance
The Software periodically checks for available updates by contacting the DeltaSketch update server. Updates to the current major version are provided at no additional charge. The Author makes no guarantee that updates will be available indefinitely. Future major versions may be subject to separate licensing terms.
14. Remote Version Enforcement
The Author reserves the right to remotely disable specific versions of the Software that are found to contain critical defects or security vulnerabilities. When a version is disabled, the Software will display a notification and prompt you to download the latest version. This mechanism is used solely for security and stability purposes.
15. Termination
This Agreement will automatically terminate if you fail to comply with any of the terms and conditions outlined herein. Upon termination, you must immediately uninstall and delete the Software from all devices. The Author reserves the right to terminate this Agreement at any time at their sole discretion.
16. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the European Union. Any dispute arising from or in connection with this Agreement shall be resolved exclusively in the courts of Spain.
17. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely reflects the intent of the original.
18. License Verification & Privacy
The Software contacts DeltaSketch servers (deltasketch.com) for the following purposes: license activation and periodic revalidation, version status checks, and update availability checks. The data transmitted is limited to your license key, an anonymised machine identifier (a hashed hardware fingerprint that cannot identify you personally), the Software version, and a product identifier.
No personally identifiable information (such as your name, email address, or device hostname) is stored or transmitted. No usage data, captured images, or project content is ever collected or transmitted.
By activating this Software, you consent to the transmission of this limited, non-personal data for the purposes described above. No data is shared with third parties for analytics, advertising, or tracking.

20. Third-Party Software (FFmpeg)
This Software uses libraries from the FFmpeg project under the GNU Lesser General Public License v2.1 (LGPLv2.1). FFmpeg is not owned by the Author. The FFmpeg libraries are dynamically linked and are not modified. The source code of the FFmpeg version used in this Software can be downloaded from the
